All bankruptcy filings are handled in the U.S. District Courts because the parties involved, that is, the people to whom you owe money, are likely to be headquartered in various states. Because of this, there comes into play what is known as diversity. This diversity issue is part of the reason for requiring bankruptcy proceedings to be handled by the U.S. District Courts.

 

However, filings will be handled differently in each state, and the reason is that Federal Courts examine state law when making their decisions about your bankruptcy case. It is important to remember that while Federal laws govern many of the issues of bankruptcy proceedings, such as establishing a trustee to handle the bankruptcy estate, a U.S. District Court always abides by state laws when making rulings on certain issues.

 

Only an attorney practicing in the state, where the bankruptcy is filed, and one admitted to the bar of that state, is thoroughly qualified to handle the various elements of a bankruptcy case in the state of filing. It does not matter whether you file for liquidation under Chapter 7, or whether you are seeking to reorganize some of your debts under Chapter 11 or under Chapter 13.
