As soon as you file your bankruptcy petition, the U.S. Bankruptcy Code comes to force and orders what the law describes as an automatic stay. The bankruptcy automatic stay prevents debt collectors from contacting you for any reason whatsoever. Wage garnishments are halted, along with foreclosures and repossessions.

 

Believe it or not, creditors are not allowed to contact you once you have filed for bankruptcy. They must stop all collection calls. If they do call, they'll have to answer to the U. S. Bankruptcy Court judge and will probably have to pay fines as a result. Of course, you must go through the legal process of bankruptcy under the U. S. Bankruptcy code. The automatic stay is a temporary provision, and you still have to wait for your case to complete the legal process, but it can provide a much needed relief from your financial troubles.

 

You still have to go through the process of declaring Chapter 7 (or Chapter 13, depending on your circumstances), but at least this provides you relief, with temporary breathing time while you work things out with your attorney.

 

This step should not be taken lightly because bankruptcy does have long-term effects. However, if you can't see a way to pay off your debts within the next three to five years while maintaining a reasonable standard of living, you should contact a bankruptcy attorney help you evaluate your circumstances and to consider your legal options carefully.

 

You may heard about the the new bankruptcy law and wondering whether it has become more difficult to declare bankruptcy. It has become more difficult.
